Terms and Conditions — FoodNu

Please read these Terms and Conditions ("Terms") carefully before using the FoodNu mobile application ("App"). By creating an account or using the App, you agree to these Terms.

1. About the App

FoodNu is a personal food and recipe assistant for home cooks. It uses AI to scan your fridge, generate recipes, and log your meals. The App is currently operated by its individual founder (a corporate entity has not yet been formed) ("we", "us", "our").

2. Eligibility

You must be at least 13 years old to use this App. By using the App, you confirm that you meet this requirement. If you are under 18, you should have your parent or guardian's permission.

3. Your Account

• You are responsible for keeping your login credentials secure
• You are responsible for all activity that occurs under your account
• Notify us immediately if you suspect unauthorised access at contact@foodnu.io
• We may suspend or terminate accounts that violate these Terms

4. AI-Generated Recipes — Important Disclaimer

Chef Kai and the fridge scanner are powered by artificial intelligence.

• Recipes and suggestions generated by the App are for informational and entertainment purposes only
• AI-generated content may contain errors, inaccuracies, or unsuitable suggestions
• Recipe suggestions are not a substitute for professional dietary, nutritional, or medical advice
• If you have allergies, dietary restrictions, food intolerances, or a medical condition that affects your diet, always consult a qualified healthcare professional before following any recipe
• We are not liable for any harm, illness, or adverse reaction resulting from following a recipe generated by the App
• Always verify that ingredients are safe for your specific dietary needs before cooking

5. In-App Purchases and Subscriptions

• Certain premium features require a paid subscription or one-time purchase
• All purchases are processed by Apple through the App Store
• Prices are displayed in your local currency before purchase
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
• You can manage or cancel your subscription in your iPhone Settings → Apple ID → Subscriptions
• Refunds are handled by Apple — contact Apple Support for refund requests
• We do not process or store payment information
• If we change subscription pricing, we will notify you at least 30 days in advance via in-app notification; continued use after the new pricing takes effect constitutes acceptance
• EU/EEA consumers: You have a 14-day right of withdrawal from the date of purchase for digital subscriptions, unless you have already started using the premium content, in which case the right of withdrawal lapses. To exercise this right, contact contact@foodnu.io

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, scrape, or extract data from the App or its APIs
• Upload content that is offensive, harmful, or violates any third party's rights
• Attempt to gain unauthorised access to our systems
• Use the App in any way that could damage, overload, or impair it

7. User Content

When you use features that allow you to input content (chat messages, custom preferences, diary entries), you retain ownership of that content. By submitting content, you grant us a limited licence to process and store it solely to provide the App's features to you.

You are responsible for the accuracy and legality of content you submit.

8. Third-Party Services

The App uses third-party services including:

• OpenAI — for AI recipe generation and fridge scanning. Subject to OpenAI's Terms of Use
• Apple — for authentication, payments, and App Store distribution
• Supabase — for data storage

We are not responsible for the practices of these third-party services beyond our contractual obligations with them.

9. Intellectual Property

• The App, its design, branding, and original content are owned by us and protected by copyright and intellectual property laws
• AI-generated recipes are provided to you for personal, non-commercial use
• You may not reproduce, redistribute, or commercially exploit AI-generated content from the App without our permission

10. Disclaimers

The App is provided "as is" without warranties of any kind, express or implied. We do not warrant that:

• The App will be uninterrupted or error-free
• AI-generated recipes will be accurate, complete, or suitable for your needs
• The App will be available at all times

11. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for:

• Any indirect, incidental, or consequential loss arising from your use of the App
• Any harm resulting from following AI-generated recipes or dietary suggestions
• Any loss of data
• Any loss arising from third-party service failures (OpenAI, Supabase, Apple)

Our total liability to you in any circumstances shall not exceed the amount you paid for the App in the 12 months preceding the claim, or $100, whichever is greater.

12. Account Deletion

You can delete your account at any time from within the App (Settings → Delete Account). Upon deletion:

• Your personal data will be permanently deleted within 30 days
• Your Apple Sign in tokens will be revoked
• Active subscriptions must be cancelled separately via Apple

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via an in-app notification at least 14 days before they take effect. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which the founder resides, without regard to conflict of law principles. This will be updated once a corporate entity is formed.

For EU/EEA users: nothing in these Terms affects your statutory rights under applicable consumer protection laws.

15. Indemnification

You agree to indemnify and hold harmless FoodNu and its founders, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your misuse of the App, your violation of these Terms, or your infringement of any third-party rights.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FoodNu regarding the App and supersede all prior agreements or understandings.
